Desde este primero de octubre entró en vigencia el decreto reglamentario que faculta a la Policía Nacional para combatir el microtráfico de drogas en espacios públicos, de acuerdo con lo estipulado en el mandato del Presidente de la República, Iván Duque.
De esa manera el Gobierno Nacional busca incrementar los controles al consumo y tenencia, en espacio público, de sustancias psicoactivas prohibidas, con el único propósito de proteger de este flagelo a niños y jóvenes y mejorar la seguridad y la convivencia ciudadana.
Durante la firma del decreto, el primer mandatario de los colombianos señaló que “el microtráfico y consumo de drogas en las puertas de los colegios, en las universidades y en los parques, ha aumentado exponencialmente en los últimos años y no podemos ser indiferentes a esto. Como Gobierno tenemos la responsabilidad y el compromiso de proteger y defender a nuestros niños, jóvenes, y sus familias”.
Este decreto reglamentario al Código de Policía y Convivencia, que es una norma de naturaleza administrativa, no penal, dota a la Policía de las herramientas necesarias para confiscar cualquier cantidad de droga que un ciudadano porte en el espacio público y evitar así; que los jíbaros se camuflen en la autorización de la dosis mínima para inducir a niños y jóvenes al consumo de drogas.
La medida no penaliza la dosis mínima y es totalmente respetuosa de las libertades protegidas por las altas Cortes colombianas y por la jurisprudencia y por eso, aquellos a quienes les sea confiscada una cantidad igual o menor a la dosis mínima permitida y demuestren debidamente su condición de adictos, esta les será devuelta. Lo que se está haciendo es atender una de las mayores preocupaciones de los colombianos, dotando a los policías para que puedan combatir el microtráfico y a los jíbaros en las calles.
Judicialización
Por su parte, los decomisos de droga que superen la cantidad autorizada como dosis mínima será judicializada bajo la legislación vigente, lo cual está definido en la Ley 30 de 1986 “por la cual se adopta el Estatuto Nacional de Estupefacientes y se dictan otras disposiciones”. En su artículo 2, el literal ‘j’ define que la “Dosis para uso personal: Es la cantidad de estupefacientes que una persona porta o conserva para su propio consumo. Es dosis para uso personal la cantidad de marihuana que no exceda de veinte (20) gramos; la de marihuana hachís la que no exceda de cinco (5) gramos; de cocaína o cualquier sustancia a base de cocaína la que no exceda de un (1) gramo, y de metacualona la que no exceda de dos (2) gramos.”
Es importante precisar que el expendio de sustancias psicoactivas siempre ha estado prohibido y está tipificado como el delito de tráfico de estupefacientes. Por su parte, el consumo de sustancias psicoactivas o prohibidas en el espacio público está prohibido por la Ley 1801 de 2016 o Código Nacional de Policía y Convivencia.
El decreto tiene un enfoque de prevención y es una medida más que hace parte de la estrategia de lucha antidrogas del Gobierno Nacional y busca resguardar los espacios públicos de la realización de actividades ilícitas que afectan la salud y la sana convivencia de la ciudadanía. Para su implementación la Policía cuenta con todos los protocolos y procedimientos para abordar a la ciudadanía. El decomiso de droga se hará mediante un proceso verbal y si se demuestra la condición de adicto, se le devolverá la droga, si no, esta se destruye.
Además de fortalecer la lucha contra el tráfico de sustancias prohibidas en lugares como estadios, coliseos, centros deportivos, parques, centros de salud, y en general en el espacio público, la medida redundará en la disminución del consumo de drogas o sustancias prohibidas
